Many of you may have noticed the tape blocking off the playgrounds at the Community. The top beams of these two playgrounds are showing signs of rot and are being inspected by two local playground companies for further maintenance and repair. For your safety and that of your family, we ask that you please refrain from using these playgrounds until repairs are made and the final “ok” is given by the PCA for their use.

2012 Assessment Payment Options

Just as a reminder, you can pay your assessment in several ways: 1) Detach the bottom portion of your statement and mail your payment to the bank’s lockbox at Post Office Box 912, Columbia, SC 29202; 2) Go online to www.cmgcharleston.com and select “online payments.” You will need your account number noted on your statement for this option if you have not already setup your account. Please keep in mind that payments made online on Saturday or Sunday or after 5pm will reflect on the following business day; or 3) Download the form from our website and set-up ACH for automatic draft of your assessment. Please remember that if you have your payments set up on ACH through Community Management Group, you need to be aware that any outstanding balance will be debited from your account.

2012 Assessment

At the Ponds’ 2011 Annual Meeting, your Board of Directors presented and approved your operating budget for 2012. Your 2012 assessment has been set at $735.00 for the year. Just as last year, your assessment will be billed on January 1st and will be due by January 15th.

Golf Cart Registration

As discussed at previous homeowner forums and Annual Meetings, one of the ways we can help to manage trespassing at The Ponds is to be cognizant of owners vs. non-owners through various means of identification. Just last week, a tour of the property was being conducted and there was an abandoned golf cart at the start of the trail. There was no way of knowing if this cart belonged to a Ponds owner or if this person was trespassing, as there was no identifiable information on the golf cart. Since we request that all vehicles in the Ponds display a decal on the front windshield, owners have also asked that we provide decals for Ponds golf cart owners to help in this identification process.

That being said, if you own a golf cart in The Ponds, we ask that you please complete the attached registration form and send it back to our office address below. Once received, we will send you a decal sticker in the mail to place on the back bumper of your golf cart.

Homeowner Forum

Please be advised that on Tuesday, November 15th at 6 pm I will host another one of our Ponds Property Owner Forums at the farm house. For those of you who might be new to our community, the format is very simple. I will open with a few remarks about the status of sales, development, future plans and operations. Then I will open the floor for your questions and comments. We generally schedule such Forums each quarter so we can keep channels of communication open and encourage constructive dialog. The Forum should last about one hour and we encourage you to attend and participate.

Landscape Update

Hurricane Irene

We would like to report that we are undertaking storm damage mitigation measures for Irene. The priorities include securing amenities and common areas from possible projectiles that could damage property or cause injury.

In preparation for the possible impact of Hurricane Irene, it is important to remember to bring in any objects that can blow away, including garbage cans, lawn furniture, garden tools, grills, plants, etc. and anchor any large objects that cannot be brought inside. We STRONGLY encourage you to visit our website at http://cmgcharleston.com/storms.htm to view additional resources that can help you prepare your home and family, which you will want to do as soon as possible. The stores will be busy and some necessary items may be sold out if you wait too long.

Should there be an evacuation, our staff members are equipped with priority clearance passes and we will be touring communities as soon as a return is authorized. Our vendors are all prepared and on standby to remove obstructions and debris from access roads and secondarily from common areas. Insurance carriers have confirmed their commitment to appraise damage. Our Emergency numbers will be posted on our website as well.

Village Pond Trail Re-Opening

Golf Cart Use

Trespassing and Dogs Off-Leash

We continue to receive emails from homeowners regarding trails, ponds, and amenities at The Ponds being used by non-residents. To help in this matter, we have attached a copy of the notice that we use when citing unauthorized vehicles at the Community. As homeowners, you are welcome to print these notices from your home computers and leave on cars at the amphitheatres, trailheads, etc, if you so choose. You are by no means obligated to do so, but this is just another means of alerting those who do not belong at the Community to keep from trespassing.

In other news, we have also received emails from homeowners regarding dogs being off-leash in the Community. As a friendly reminder, all dogs must be leashed in residential areas and parks. I have attached a copy of the Community's Rules and Regulations should you wish to peruse them. Please do not hesitate to contact me should you have any questions or concerns regarding any of these Rules and Regulations.

Pool Opening

After much consideration and at the request of several owners, The Ponds Community Association has decided to extend the 2011 pool season. The pool will now be open from April 1st through October 31st.

As a friendly reminder, we must ask that you please abide by the following rules, in addition to the posted pool rules: 1) Please do not prop the gate open or it will set off the Sonitrol alarm (the alarm is silent, but still alerts Sonitrol and can result in major costs to the Association); 2) Golf carts are not allowed inside the pool enclosure; 3) All members must arrive at the pool with a valid keyfob for access (this is to protect all homeowners and the Community). If someone tells you they "forgot" their key or "lost" it, please refer them to our CMG office at (843) 795-8484 ext. 330, as they may not be a member of The Ponds or they may be a delinquent homeowner (the Community deactivates all delinquent owner's keys); 4) If your pool keyfob has been lost or stolen, please contact our office to obtain a replacement. The replacement fee is $50.00 and payments should be made payable to "The Ponds." Please remember that only one keyfob is allowed per property.

Security Gate Update

For those of you who were able to attend our recent Homeowner Forum, one of the suggestions offered was to add a second gate past the Farmhouse to help increase security measures. We are happy to inform you that a new gate has been added just past the Farmhouse and will be locked at all times to help discourage trespassers. Your Shultz Lake gate key will open this new gate lock.

As a friendly reminder, we ask that you discuss this new gate with your family and guests and make sure that anyone using this gate locks it behind them whenever they enter or exit the area. As property owners, we ask that everyone do their part to help keep this gate in good order and repair, and to see that it is locked at all times. If you happen to be having an event at the pool/Pavilion, you are welcome to leave this gate open for guests; however, we must ask that whoever is the last one to leave be sure it is locked at the end of the event.

Please also note that the lock at the Amphitheatre has been rekeyed and your Shultz Lake key will also service this lock. We have done this so homeowners can access this area for boating and fishing. Once again, we must ask that you remember to ensure that this area is locked behind you upon entry/exit to ensure trespassers are not provided access to this area.

As always, please do not hesitate to contact me should you have any further questions or concerns regarding this matter. If you require a Shultz Lake replacement key, please do not hesitate to contact me. The replacement fee is $50.00 per key and your check should be made payable to "The Ponds Community Association."

Decal Reminder

As a friendly reminder, please do not forget to place your Ponds decal on the windshield of your vehicle(s). Placing this decal on your windshield allows PCA staff as well as the Dorchester County Sherriff's Office to identify Ponds homeowners from non-owners. On several occasions, the Sherriff's Department has been called out to The Ponds to question people fishing and picnicking at the Amphitheatre only to find out they are, in fact, Ponds homeowners.

We truly appreciate your cooperation in this matter. If you require an additional Ponds decal, please do not hesitate to contact me so I may assist you in obtaining one.

Construction Violation Reporting

In recent months, our office has received calls and emails regarding the work hours kept by a few of the builders at the Community. As many of you may know, construction (interior and exterior) shall occur between 7 a.m. and 7 p.m. Monday through Saturday. No construction shall take place on Sundays or major legal holidays (New Years Day, Easter, Memorial Day, July 4th, Labor Day, Thanksgiving & Christmas).

As a friendly reminder, if you happen to witness a builder committing a construction violation and wish to report this to the Association, please do not hesitate to do so. We are required by the Ponds Construction Fine Guidelines to supply the date, time, and description of the vehicle(s) (license plate number, make, and model required) in violation. We also ask for you to include a photograph and a detailed description of the incident for which the violation occurred. Not only is this required by the Association, but it is also for the builder’s benefit so they can go after the right subcontractors who are breaking the rules.

Trash Can Storage

Now that enforcement inspections are in full swing, we have received several homeowner phone calls regarding trash can storage. Per Article III, Section 3.10 of the covenants, trash cans must be shielded and hidden from view. While The Ponds allows trash cans to be placed on the curb Wednesday through Friday for trash pick-up, they must be returned to their appropriate screening Saturday through Tuesday. This means that trash cans may not be placed at the top of your driveway/near your garage, even if they face an alley, as that is not considered to be shielded from view.

Enforcement Reminders

Now that the New Year is here, CMG will resume routine covenants inspections of the Community. As a friendly reminder, all trash cans must be screened from view Saturday through Tuesday. You may place your trash can behind a screening fence or natural buffer, or enclose it in another location that is hidden from view (for example, your garage). Also, please remember that boats and ATVs of any kind are not allowed at the Community.

Ponds Pool Deck Still Open

Pool Closing

As September comes to a close, we would like to take this opportunity to remind you that the Community pool will be closed on October 1^st for the remainder of the season.

Per DHEC requirements, homeowners will not be allowed to swim in the pool until everything re-opens in the spring of 2011. We appreciate your cooperation and understanding of these guidelines.

Coyote Awareness

Jack Kornahrens has now found at least two dead domestic dogs on the property due to coyotes. Last year they baited and trapped them with deadly eradication only as a last resort.

We wanted to let you know that beginning September 1st coyote depredation will commence. There will be no trapping this year based on the advice of the Department of Natural Resources. As residents, we wanted to let you know that you may hear some gun fire but the bait stations have been placed on the outer fringe of the property. Pool Shower

We received a report this morning that the pool shower was continuously running. Fortunately, we were able to make the necessary repairs and the shower is no up and running and fully functional.

After Hours Construction

Village Pond

Some of you may have noticed the recent algae burst at the Village Pond. With the consistent hot, humid days then the bursts of rain, it has been a breeding ground for algae. That said, we would like to inform you that the Lake Doctors was out on property on Monday treating the pond and will be back again next week to conduct another round of treatments to help clear the algae. As always, we appreciate your patience while we work to correct this matter.

ATVs

As a friendly reminder, per your covenants ATVs are not allowed at the Community. CMG has been asked to strictly enforce this covenant and we will be sending violation notices to anyone who violates this rule.

Furthermore, we would like to remind you that golf carts, while allowed at the Community, must be operated by a licensed driver. Anyone under the age of 16 found to be operating a golf cart will also be cited.

Pool Water Fountain and Amphitheatre Statue

We are happy to announce that the water fountain at the pool has been repaired and is fully functional. We appreciate your patience while we worked to correct this matter.

We are also happy to report that the large female statue at the Amphitheatre (which was thrown in the Village Pond last week) has been put back on her bench and is sitting happily once again.
As always, we rely on homeowners to be our second set of eyes and ears at the property and ask that if you ever notice something out of the ordinary, to please report it to our office right away.

Golf Cart Use

We have received complaints about kids driving golf carts in the Community and racing them with other kids, often times in the middle of the street. It is important to remember that the streets of The Ponds are public and as a result, are under the jurisdiction of Dorchester County. All County laws regarding the roadways must be followed.

We ask that when using golf carts in the Community you abide by Dorchester County laws and respect your neighbors by driving these golf carts safely and responsibly.

Trespassers at Village Pond

Just as a friendly reminder, the Village Pond is a private pond and its use is for residents only. If you ever see anyone who is not a member (or guest of a member) of The Ponds fishing at the Village Pond, please contact the appropriate authorities as follows:

1) Please call SCDNR dispatch at (800) 922-5431. Our point of contact is Sgt. Lee Ellis.

2) If SCDNR dispatch is unavailable, please call 911.

While these circumstances may occur during a weekday and you are always welcome to call CMG, our team is not available after 5pm on weekdays and our office is closed on weekends, except during emergencies. Since a trespasser is not an emergency, we ask that you as homeowners take the initiative to contact the appropriate authorities. Without immediate action, these trespassers will not be caught.

We understand this may be an uncomfortable situation and for that we apologize. However, we must all keep in mind that this property belongs to all of you and it is your duty to help protect it. In order for trespassers to stop using PCA amenities, they need to be reprimanded and fined. This is the only way to protect and preserve the Community and to keep its many amenities from being abused by outsiders.

Pool Opening

Door to Door Solicitors

Door to Door Solicitors
Summerville residents are reminded to be aware of door-to-door sales people, particularly “magazine sales”. Usually the concerns about these individuals are property / financial-crime related, but the possibility of a physical assault should not be ignored.
Tips:
1. Post a NO SOLICITING sign on your front door, and maybe another in the yard. (One at the front of the neighborhood is not enforceable)
2. DO NOT Open the door to ANY strangers
3. If someone claims to be from a utility or law enforcement, Request to see ID (through window) and look for an official vehicle.
4. If they are “selling” anything, know that it is perfectly fine to tell them you are not interested, to please leave.
5. If you are interested, request to see their Peddler’s Permit from the City of Summerville (again through the window - see info below).

Know that solicitors are probably breaking the law if they do any of these:
1) Knock IN SPITE of a NO SOLICITING sign
2) Do Not have a City Peddler’s Permit with them(and their company is to
have a Business Permit)
3) Tell you the magazine sale can be donated to be delivered to a charity
(like the Boys & Girls club, etc)
4) If they use ANY High Pressure or Intimidation or will not leave

What to do:
Call the Dorchester County Sherriffs Dept., give a description of the subject and
their direction of travel, so an officer can interview them. (Ask to speak to the officer so he can get more details). If they are operating within the law, you'll be advised. If not, they will be dealt with accordingly.

National Association of Letter Carriers Food Drive

Many of you may be aware about the National Association of Letter Carriers Food Drive that happens every year on Mother’s Day weekend. All of the food that is collected (last year it was 100,000 pounds) comes to the Lowcountry Food Bank. All homeowners have to do is leave a bag of food at, in, or by their mailbox and the letter carrier picks it up and brings it back to the local post office.

Walking Trails Re-Opened

We are happy to announce that The Ponds’ walking trails have been cleared of storm debris and have now been re-opened to the homeowners.

Walking Trails Closed

Due to the winter storms, all walking trails within The Ponds are off limits (including the one to Shultz Lake). Repairs will take 7-10 days (if this rain subsides quickly).

Please use only sidewalks or roadways while venturing out on the property. There are very dangerous situations on the trails so please adhere to this request. Thank you!

Vandalism

We have had recent reports of vandalism to the areas around the pool. As a friendly reminder, we ask that homeowners and their guests pay careful attention to and respect the amenities at the Community. The cost to repair or replace these items are passed on to homeowners in the form of assessments. Increased costs to maintain these items will only result in increased assessments.

We understand that these acts may be the result of people coming into the Community who do not reside at The Ponds. If you ever see any suspicious activity or acts of vandalism going on at the Community, please call the police immediately and also report the incident to Community Management Group directly at (843) 795-8484 ext. 330.

Shulz Lake Gate Key

The Association provides keys to the Shulz Lake gate to all homeowners at The Ponds upon purchase of a Lot. This key is for Shulz Lake only and no access key is provided for the gate to Simmon's Pond.

As a friendly reminder, if you lose or misplace your key to Shulz Lake and require a new one, there will be a $50.00 replacement cost. We also ask that you please refrain from trying to force these locks open, as they are fragile and will break your key in them. Any key that is broken off in a lock will result in a $50.00 replacement cost.

Happy Thanksgiving & Holiday Safety Tips

On behalf of the entire management team at Community Management Group, I would like to wish you and your families a very healthy and happy Thanksgiving!

Now that Thanksgiving is here and as the Christmas season approaches, the Sheriff's Office has asked us to assure you and your neighbors that they are taking measures to combat and prevent the normal increase in criminal activity which occurs this time each year. They also wish to stress the importance of citizens doing their part to protect themselves by not presenting opportunity-criminals with the chance to ruin your holiday. Additional officers will be on high-visibility patrol around shopping areas, banks, and the like. They will also be available to provide bank escorts for businesses that request them.

Particular problems this time of year are theft from automobiles and residential burglaries. These are the most preventable crimes. If citizens remove the opportunity, the crime is less likely to occur. Here are some tips to help protect your home and property:

At Home:
• Make sure to keep doors and windows locked.
• Turn on outside lights at night.
• Report persons or vehicles roaming your neighborhood, day or night so police may check them. They may be simply looking at Christmas lights, or they may be “casing” houses to burglarize.
• Place your tree where the gifts will be less visible from outside. Thieves like window-shopping through your windows.
• After Christmas, don’t put the empty boxes out on the curb. This makes it easy for burglars to decide which houses to burglarize (ie: new computers, TVs, electronics, video games…). Break down boxes and put them in the trash, making sure to save all paperwork. Also remember many electronic devices require original boxes for warranty repair.
• Immediately make an inventory listing the model and serial numbers of new items (and old ones if you haven’t already) and engrave personal markings on them (example: “SCDL 1234567”- using your driver’s license number helps police get recovered stolen items back to the owner).

If Leaving Home:
• Make it look like you are still there.
• Timers on exterior lights, interior lights, and TVs will help make it look like you are home. Don’t leave an answering machine message saying you are gone, in fact turning it off would be better.
• Double check all doors and windows, including second floor and basement. The doors should have dead-bolts; key locks for windows are also available.
• Have the neighbor pick up mail, papers, and ads, put out your trash can, and park in your driveway. Give them emergency and cell numbers to reach you.

The association is experiencing some trouble with animals on the walking trails. This is currently being addressed. Please make sure to stay on the paths while hiking or walking while we are rectifying this issue.

Please remember that the public can navigate the waters via Slands Bridge off of 17-A. Make sure that your boats and canoes are secure at Schultz Lake.
Also remember to report any suspicious persons to the police department. Owners are only allowed to use the amenities at The Ponds. Two teenage boys were found using the lake and they were asked to leave. They stated that the YMCA gave them permission. The YMCA can not give permission to use the facilities.

The pool phone has been struck by lightning and we have ordered a new phone. During this time, the sales office phone will be used in case of an emergency during business hours. After business hours, the pool will be closed.

June 13th the Department of Natural Resources will hold a fishing rodeo at the Village Pond. This event is a free family event. The event will help teach children 5-12 about fishing.

Installation of the pine straw is complete and it looks great!
The trails on the left hand side of the property (ponds side) will be closed Saturday for maintenance. Please avoid that area and stay on the trails to the right of the boulevard.
Flowertown Festival's Premier Concert "Sunset Serenade" is Saturday April 4th from 6-9 at the amphitheatre. Be sure to bring your lawn chairs or blankets. The event is free, but donations for the orchestra will be accepted. The orchestra begins at 7:30 p.m., but the Charleston Chinese Dance Group and acoustic guitarist, Irene Smith will be performing prior to the orchestra. The finale will be a wonderful fireworks display.
Property Owner update meeting is scheduled for April 21, 2009 beginning at 6:00 p.m. in the farmhouse.
